Citizens case- Forget Constitutional Amendment& think IMPEACHMENT! |
|
Both Alito and Roberts testified under oath they would respect precedent before they overthrew over 100 years of precedent to 'legislate' that corporations had freedom of speech like they were people, and that money was speech {if dead presidents start talking maybe they were right on that count} IMHO Both Alito and Roberts were affiliated with the Federalist Society, bunch of takeover government via Judiciary Conservative Ideologs, in violation of the Federal Judicial Code of Ethics requiring the Federal Judiciary to avoid every apperance of bias.
NB: Before this impeachment can succeed we need to elect pro democracy (99% IS a democratic majority) candidates.
Besides, Constitutional Amendments take forever and super majorities, not so impeachment proceedings - - look what they almost did to us with Clinton and FOR WHAT?!?!?

1. Good idea but impeachment could take a year or two to get started. |
|
And the tea party clowns running the House it's not gonna be easy. If we do manage to get them off the bench we need to do so while we have a Dem in power - it'd be useless if another republican takes office in 2013.

4. I'm hoping the Occupy folks, and the 80%+ who approve their thinking |
|
will replace the tea pottie types.
The reason, IMHO, those guys got elected was because the billionaire types like Norquist, and the Koch bros, funded their campaigns. 90%+ of the time, the one with the most money wins the election.

5. There's got to be some way to overturn Citizen's United. |
|
Once we do that - I'm hoping shit like the tea party goes away for a long time.
I hate to draw the comparison but the rise of the tea party and the rise of Nazi Germany are pretty similar.

3. Impeachment is a two step process. Impeachment is just the |
|
first step. It's like an indictment leading to the second step, a trial. After Clinton's 'trial' there were not enough votes for the second step, removal from office.
IMHO If the two lying neo Fascist 'justices' are impeached then removed from office, it is virtually certain the Citizens case will be overturned with their replacements. This assumes we won't have another Right Wing Republican nominating the replacements.

10. In a split Senate or one likely to be controlled by the GOP, who in touch with reality |
|
would actually believe that there ever would be enough votes for conviction?

6. i understand your frustration, but your proposal is pure fantasy |
|
To begin with, the first step for impeachment involves action by a majority of the House of Representatives. As you are aware, the House has a fairly one-sided repub majority -- 25 seats. You won't find two repubs to support impeachment, let alone 25. Indeed, an impeachment resolution would never make it out of committee.
Moreover, a significant number -- possibly even a majority -- of Democrats in Congress would not support impeachment based on the grounds you cited. Both Alito and Roberts hedged enough in their testimony (as would any nominee) to leave room to "re-examine" settled case law. And given the Court's history of overturning settled, but bad rulings, like Dred Scott, there isn't going to be much enthusiasm for arguing that the Supreme Court, while "respecting" precedent, is free to re-examine and possibly even reject it.
Finally, as for Alito and Roberts being affiliated with the Federalist Society? So what? Felix Frankfurter founded the ACLU and Ruth Bader Ginsburg worked for the ACLU. I don't think there is anything wrong with that. Nor do I think an "affiliation" with the lawyer's guild or the American Constitution Society should disqualify someone from serving on the Supreme Court. (I should note, by way of full disclosure, that my dad's membership in the Lawyer's Guild back in the 30s was used against him by a young Congressman from California, a guy named Nixon, to block my dad's promotion to a senior government position -- so I have a personal reason for not wanting one's prior affiliations with organizations with a point of view to be used against them).
Bottom line: there are ways of working back from CU -- narrowing rulings, maybe overturning it, a constitutional amendment . None are easy, but the one in ten chance of any of them happening is 100 times greater than the chances of Alito and Roberts being impeached.

8. Thomas and Scalia need to be impeached for obviously |
|
being influenced by those whose cases appear before the USSC, and Thomas for his obvious corruption.

9. Corporate personhood was crushing us pretty good well before Citizens United |
|
I believe it will have to be done by amendment to truly corral this beast.
I also don't see your grounds flying even with a heavily Democratic Congress and you're dead on arrival at the moment.
