After all my whining, it's only fair to post some good news.

Chase approached my mom about a loan modification on a rental property, just before or during the crash. They pretty much lured her into foreclosure, promising to re-fi her little building. They had no intention of giving her a modification and my proof is that they had her in the wrong program for over two years. The program they put her in was only for residences, not income property.

It must have seemed so easy to them. An old lady, offer her a better rate if only she goes into foreclosure to "qualify" for the program. Then, just sit back and wait for it.

So, during those two years, she complied with all their requests for docs and financial information. When she called to check, she was told, everything was fine. Or she was told, we didn't get your paper. Or she was told to just wait and someone would get back to her. At the bottom of two years, they said, you have to pay a $15,000. balloon payment to get the modification, which was impossible. And by this time, there was zilch to pay a lawyer. And then, they sold the property.

Except, oops, she found a way to get the sale reversed because it was illegal. A part owner was in bankruptcy and Chase never bothered to run that down. They were on a roll, I guess, and while they were counting their money, Mom was on the net every day trying to find a way to stop this theft. And she finally has found a lawyer who will work with her without a ton of up front money.

So, fuck you, Chase, and cheers to my mom who fought these Major @assholes on their own turf and won.

8. The best part is that she rents to low income families
and has up to now refused to be part of the gentrification of that neighborhood which would mean kicking those tenants out at some point. She's Chase's nightmare. lol

9. She's been at this for more than two years now and on her own.
I've given her everything DU has posted on foreclosure fraud and that helped a LOT because at first she and I both thought we were nuts for suspecting foul play. And then the situation got really, really clear.

The bank couldn't produce all the paperwork. So he got his house back and then sold it and made a tidy profit. :)

26. It's only a few years since the crash but it feels like ten.
At one point, this place was in foreclosure too, and I'd stay awake trying to figure out where I would take my mom and the animals.

I think she will be okay. The bank sold the building for less than have of what they wanted to stick Mom up for. It's going to be hard for them not to write the property down now. And now she's free to get real financing elsewhere, too.

FYI, was chatting with a great lady at my credit union last week, and she said Chase is the absolute worst bank to deal with refi's - they delay and delay all the time.

it just occurred to me that all of this stealing of property through false foreclosures, etc., is part of the plan the 1% is attempting to institute to change who has the right to vote in this country. There is a line of thinking I've heard expressed that states that only people who own property should have the right to vote... if the 1% is able to steal property away from their owners with the collusion of the courts, then in the end, the right to vote will be stolen from a lot of adults who currently have that right.

The banks really thought that they could get away with outright theft--thankfully, they are, instead, exposing their corruption by the hubris of not doing "due dilligence" when it comes time to enter into a court of law... in other words, (enter my rant here)they hired too many lawyers and MBA's with a less than 2.0 GPA who barely made it out of school and/or barely passed the bar and all of this bs that these banks are getting caught in exposes that.(/enter my rant here)

and to homeowners, not for income property. Mom did not find that because there's none there. The lawyer she found agreed to defer his payment, not reduce it. But if in your alternate universe that makes you right, cool.

whining? I don't think so. You are one of the best posters on DU. I saw a post today where someone complained about this board becoming anti-Dem. Well many people here including myself may be anti-certain Democrats, we are not anti-Dem, there is a big difference between throwing your weight behind a person and throwing your weight behind an ideal.

I talked to the DA about a year ago. At that point, I was only asking for resources but I talked to someone who was putting together a database of problems. It would be interesting to know if that ever went anywhere.

87. Maybe you should send all the info to the US Attorney.
My friend, who was also illegally foreclosed on, has done that, in NY. The Bank in her case was Wells Fargo and the law mill that handled her case, is the one the NY Times wrote about that had the Halloween Party mocking people who had been foreclosed on.

Looks like she may be entitled to compensation as she has heard from the Government asking her to fill out forms so they can look into her situation. There is also a huge class action suit against that law firm going on and a criminal investigation into their practices. I did not think this would happen so fast, a little justice for some of those who were scammed, like you mom. So, you never know :-)

89. The Feds are working to let banksters off the hook.
They are pressuring our state Attorney General to not hold Chase et all accountable criminally and to settle for very little. The Feds will not help with this, they already threw in with the banksters.

And if the Feds have done that, there won't be much if any relief coming from the states or counties because the political pressure is too great. No one will want to risk their career over this, imo, and maybe they are right for the moment.
