Ind. lawmakers consider repealing alcohol ID bill

INDIANAPOLIS (AP) — An Indiana law that requires all people — regardless of age — to show identification when buying alcohol has caused headaches for some shoppers, but liquor store representatives are urging lawmakers not to repeal it.

Law supporters told a House committee Wednesday that they've seen a drastic drop in attempts by minors to buy alcohol because they know they'll be carded. John Livengood of the Indiana Association of Beverage Retailers says the six-month-old law is not that inconvenient.

"It has driven attempts to buy by minors to almost zero and that is a good thing," Livengood told WTHR-TV in Indianapolis.

But some lawmakers want to repeal the law after being bombarded by backlash from constituents who say it defies common sense to ask an 80-year-old for ID.

...
Under Indiana law, clerks commit a misdemeanor if they don't ask for identification when selling alcohol. The law offers clerks a defense if they fail to card someone who appears to be at least 50 years old, but Steuerwald said clerks can't use that defense until after they've been arrested.

"We've all heard from people all throughout the summer (about) how ridiculous the law is," Sen. Johnny Nugent, R-Lawrenceburg, told the Indiana Daily Student. "It's an embarrassment to everybody."

1. In Michigan you have to ask anyone that looks under 40 for ID
when purchasing tobacco. I imagine it's the same for alcohol, but where I worked, we didn't sell alcohol. No matter what the law, underage people are going to find a way to get what they want, whether it's alcohol, tobacco or illegal drugs. Personally, I feel that there are bigger issues that lawmakers need to spend their time worrying about.

3. The addiction to stupidity? A misdemeanor for checking an ID?
Not trusting someone to be able to tell someone is over 18? Governments don't trust us, tell us not to trust each other, punish people, and yet expect us to trust them....

I can see a fine against the business for failure to follow the law, but arresting someone? Give me a break.

5. I'm in IN and I complain everytime I buy alcohol about this ridculous law.
I'm 63! I asked a clerk the other day that it would be interesting to know how much time a business spends on doing these checks. She said, it's incredible. So I have to wonder about the liquor store representatives urging no repeal! I don't help matters as I am in IN temporarily with a ND driver's license! So, of course, the clerks don't know where to look for the birthdate..they also card 'old' people for tobacco.
