Chase Hit With SEC Whistleblower Complaint Over Credit Card Practices

Linda Almonte, a former employee of JPMorgan Chase (JPM) who is suing the bank for wrongful termination, has just upped the ante: She has now also filed a whistleblower complaint with the Securities and Exchange Commission. The core allegations add context to her lawsuit, and they charge Chase with grotesque and illegal practices involving its credit card debt processes, including robo-signing. Chase denies her claims.

Almonte's allegations are detailed in the Nov. 30 letter sent to the SEC. In the letter, she says:

1. Chase Bank sold to third party debt buyers hundreds of millions of dollars worth of credit card accounts. . .when in fact Chase Bank executives knew that many of those accounts had incorrect and overstated balances.

3. Chase Bank executives routinely destroyed information and communications from consumers rather than incorporate that information into the consumer's credit card file, including bankruptcy notices, powers of attorney, notice of cancellation of auto-pay, proof of payments and letters from debt settlement companies.

4. Chase Bank executives mass-executed thousands of affidavits in support of Chase Banks collection efforts and those Chase Bank executives did not have personal knowledge of the facts set forth in the affidavits.

5. When senior Chase Bank executives were made aware of these systemic problems, senior Chase Bank executives -- rather than remedy the problems -- immediately fired the whistleblower and attempted to cover up these problems.When I reached Almonte's lawyer, George Pressly, for comment, he was shocked that I had the letter because it was supposed to be confidential. While Pressly was willing to confirm Almonte was a client, beyond that he had no comment. Pressly, who was clearly trying to figure out how to handle the letter's disclosure, said he was suddenly getting a "firestorm" of calls and seemed unprepared for the onslaught. While he has filed many SEC complaints before -- he operates the website http://www.secwhistleblowerprogram.org/, which is how Almonte found him -- her letter is the first one he's filed that went public.

Concerning robo-signing, Pressly wrote:

"On numerous occasions, Ms. Almonte witnessed these Affidavit Signers work through at times 3-feet tall stacks of Judgment Affidavits at once during weekly multi-hour long, non-related company meetings. The notaries were not present at these meetings. The Affidavit Signers simply relied on hourly workers to reconcile amounts owed and then treated the actual execution of the affidavits as busy work to be performed while the Affidavit Signers could focus on other matters."

8. Does anyone believe this is limited only to Chase and BOA?
The focus has been on foreclosure fraud, robo-signers, but of course credit card loans, student loans and car loans
all have been securitized.
I have no reason to believe these tactics do not include all of the above loans.

It is now proven to be dangerous to borrow money from these institutions.

9. Yes, thats the most shocking thing. "ALL of these things have been securitized and
leveraged. ALL OF IT! On top of that, the heads commit fraud and resell the securities to unwitting investors/dupes, based on cooked up bookeeping. I have no doubt this is likely industry wide.

37. Yes, the MERS robosigning and forged signatures/faked notary crap especially was pervasive
The foreclosure-fraud watchdog blogs are flowing with testimonies and legal depositions confirming what a widespread monumental mess this is. ALL the big banks used MERS.

Btw, when I learned that, I emailed OFA, denouncing Dimon. I doubt anyone took notice. I also seem to remember that Dimon was a Dem at one time... could not believe it.

But he has done world wide damage to humanity with his so called "advice".

As an example, in 1995 , as clintons under sec. of treasury, he managed to acquire a loan for Mexico. They were broke like we are now.Congress would not pass it.

Then he charged exorbitantly high interest rates. This started the mass influx of Mexicans to America. Loans that had been say 7% went to 30% for houses, vehicles and businesses. Alan Greenspan said in his memoirs that he formed a lasting bond with Summers and Rubin over the brilliance of that loan. It was paid off early. Does anybody question why suddenly the US got another slave class? Or why people would leave family and friends to work in a foreign country without speaking the language?

23. My CPA says he sent a letter to the IRS, but it does not seem to have been answered.
In all honesty, I really cannot tell if he screwed up ( there is some possibility of that, to be honest)
or
if the IRS is bulldozing us the same way the banks are.
I DO know the IRS has sent demand letters to taxpayers when it has turned out the taxpayers owed no money, and once challenged, the IRS has dropped the matter instantly ( twice in my case,).
Other people have told me the same thing happened to them, my CPA says is it " very very common".
Currently I am "letting" my CPA fight an unreasonable demand yet again from the IRS.

It almost seems there is a unified plan to grab as much money and property as possible, quickly, from the
public. In every possible way.

I had a checking/savings account with them for some years but closed it a couple of years ago and moved my money to a regional credit union - what a great liberating feeling it was. Instead of my cash helping pay some exec millions my cash, however small, makes me part owner of the CU.

That's the way to hit them where it hurts.

When I call my credit union, if I want to speak to a live person, I just hit "O" and a nice human comes on very quickly. I believe it's important to thank our community banks/credit unions for great service - they deserve it.
