Republicans lose control of another US Appeals court
With the following news:
Judge Susan Black of the federal appeals court in Atlanta on Friday notified President Barack Obama she was taking senior status, opening up a second vacancy on the bench...

Black said she will continue to take a full case load until her successor is confirmed by the Senate. "I think it's important for me to continue doing that," she said. "I'm healthy. I love the work."

Black, 67, was appointed to the 11th U.S. Circuit Court of Appeals in 1992 by President George H.W. Bush.

Control of the 13 US Courts of Appeals (including the Federal and DC Circuit) is now as follows

Democrats control the following appeals courts:
2nd Circuit, 3rd Circuit, 4th Circuit, 9th Circuit = 4 courts

Republicans control the following appeals courts:
5th Circuit, 6th Circuit, 7th Circuit, 8th Circuit, 10th Circuit, DC Circuit = 6 courts

Courts of appeals where Republican and Democratic appointees are evenly split:
1st Circuit, 11th Circuit, Federal Circuit = 3 courts




The above judge who semi-retired was appointed by Jimmy Carter to the District level before being appointed to the Circuit. The successor is expected to come from Florida.

2. Another name to add to a LONG list of appointees held up for no reason.
A bit of a misstatement because we know that most of them are held up for political reasons.

Seems like there should be a max 3 month hold on all appointees. It's ridiculous to allow these positions to go vacant over one side's hopes that they'll still be empty once they get their "man" in the White House.

3. You know what this means? When the 11th circuit meets en banc to rule on the healthcare decision

they will likely tie. Which means the 3 judge panel decision (that has yet to be made) will stand.

Which means the random selection of judges that make up the 3-judge panel to hear the appeal of Judge Vinson's healthcare decision will likely ultimately determine the outcome of the case, at least until the Supreme Court reviews it.
