Nose stud lawsuit given more time

The federal case of a Clayton High School student suspended because of a piece of jewelry on her nose has been continued until Feb. 14.

Attorneys for 14-year-old freshman Ariana Iacono and Johnston County Public Schools agreed to have the case continued.

In October, a federal judge allowed Iacono to return to classes after she had been suspended for wearing a small nose stud that she said was an expression of her religious beliefs. U.S. District Judge Malcolm J. Howard granted a temporary restraining order that prevents the school from disciplining Iacono because of the jewelry.

The American Civil Liberties Union of North Carolina filed a lawsuit in October alleging that the school violated Iacono's constitutional rights by refusing to grant a religious exemption to its dress code. Iacono and her mother belong to the Church of Body Modification.

1. Church of Body Modification...
Makes about as much sense as any other religion. I wonder if my boss would fall for me being a member of the Church of Mandatory Wearing Blue Jeans to Work Every Day? :rofl:

3. I don't know why they need the religion angle.
Arguing strictly on freedom of expression (within reasonable limits) would be more credible.

4. Schools are allowed to restrict freedom of expression via a dress code
or even a uniform (rules vary state to state).
