Well, it's not as much an outrage as it the headline makes it seem. Both campaigns used the same stock photograph from Getty Images.

Hardly two hours old, the nascent 2012 campaign of former House Speaker Newt Gingrich has already been hit by its first embarrassment: It used of a stock photo for its website that first appeared on the website of the late Massachusetts Sen. Ted Kennedy, a liberal icon of the Democratic Party.
