Arizona Considers Bill to Create State Army


The state of Arizona would seem to be playing a political game of one-upmanship with itself. After adopting the most controversial anti-immigration law in recent memory, after selecting an official state firearm only two months following the Tucson shooting, after banning Latino activists from Capitol hearings on immigration bills, the legislature will now consider creating a state army.

SB 1495 would give Republican Governor Jan Brewer the authority to establish “an armed force” that would be entirely separate from the National Guard. Brewer would be able to call up this state militia if a “major portion” of the Guard is away on service or “for any other reason the governor considers to be necessary.”

The implication would seem to be that a state could declare war on a foreign country.

6. Of course not. If a state could legally have its own army--Texas would already have one
Article 3, Section 8, Clause 12 gives Congress the power to raise and support armies. Section 10, Clause 3 states that no state shall without consent of Congress keep troops or ships of war in time of peace. Article 4, Section 4 states the United States shall protect the states from invasion. The Tenth Amendment then states that all powers not delegated to the United States are reserved to the states or to the people. Since the power to raise armies has been delegated to the US, the states do not have that power.

11. I had thought about moving there
Oklahoma is pretty bad, but Arizona may be worse. I have a buddy with family there and he won't he go there to see them.
