19-year-old accused of unusual burglary at high school

Platte County authorities today accused a 19-year-old man of breaking into a Northland high school and masturbating on a pile of underwear taken from boys’ lockers.

John P. Gallagher of Smithville faces one count of second-degree burglary. He was being held in the Platte County jail after failing to post a $5,000 bond, Platte County Prosecutor Eric Zahnd said.

Gallagher allegedly entered the Platte County R-III High School through an unlocked window. He left the underwear in an unused locker, according to court records.

He trespassed. He broke and entered.

He may well have left something behind - but he didn't take anything.

There isn't enough evidence to support a burglary charge (1) unless there is some evidence that he intended to commit a crime while inside the premises or (2) unless masturbation is a crime in this location.
