Judge Halts Implementation Of Bargaining Law
Judge Issued Restraining Order Over Bill
Updated: 5:30 pm CDT March 29, 2011

MADISON, Wis. -- A Wisconsin judge has ruled that there should be no further implementation of a law taking away nearly all collective bargaining rights for most public workers.

Dane County Circuit Judge Maryann Sumi said Tuesday that her earlier restraining order saying the law shouldn't be enacted had either been ignored or misinterpreted.

Sumi stopped short of saying the law was not already in effect. She said she will take more testimony on that issue.

The Legislative Reference Bureau posted the law on a legislative website Friday, leading Gov. Scott Walker's administration to declare the law was in effect.

7. It's not over.
Either party will appeal. Recall elections are stoking hot, the Democrats are being showered with money and support like never before.

We have a long fight and, I am TELLING YOU, we are in it for the long haul. So, send your WOO!! to the people of Wisconsin, not this one order.

Today was fascinating and clarification to the TRO was just a small piece of it. The SoS (a Democrat whose family has a VERY rich history see: http://en.wikipedia.org/wiki/Robert_M._La_Follette,_Sr .) appeared in court represented by the state. It was determined that he needed independent counsel because his interests weren't being met. Walker appointed attorneys who asked to be removed because they didn't want to argue SoS's position. SoS was allowed to use his personal attorney (at his own cost).

They watched a youtube video of the joint committee meeting.... minority leader rocked the house.

Interesting stuff here in WI these days.

but I read their success rate in getting signatures is comparatively low.

RE LaFollette -- You write that SoS LaFollette was allowed to use his personal attorney at his own cost -- I didn't know that. I read that today Sumi ordered Walker to appoint an "independent" attorney for him, at the states cost. Did LaFollette get his own in such a short time, or what happened ? Interesting alright!!

18. His attorney was in the audience the whole time. Walker DID appoint counsel, but the atty said he
wasn't comfortable arguing LaFollette's position and asked to be removed. LaFollette was given the option of using his atty (Sage) and he did.

19. GREAT! Thanks for clarifying
That really was the only fair option for LaFollette anyway.

14. As an aside, when I joined a union, I signed a piece of paper and
had the dues deducted from my paycheck. No hassles, no protests, no demonstrations for the right I had to join a union. Things have gotten very ugly.

16. I think I have a grasp of the situation
but the notion of an illegal law makes my head spin. I'm glad my son is an adult and I don't have to explain it to a five year old with the never ending series of "why"'s.

There's no giving up for Walker when it comes to this "law", and he's a limbo champ when it comes to lowering the bar. If it gets any lower, it will get higher in China.
