16 Middle-aged casino waitresses fired after told they don't look good in new uniforms
Sixteen cocktail waitresses at Resorts Casino Hotel in Atlantic City were fired after being told they’re not a fit for the casino’s new sexy uniforms.

All of the 16 women who lost their jobs were middle-age, long-time employees who were happy to retain their jobs after the casino’s sale only to lose them because of their appearances in a skimpy costume.

Union officials say that Resorts is using the 1920s flapper-style uniforms as a way to get rid of older cocktail waitresses in order to cultivate a younger clientele.

One of the fired waitresses, Nancy Schromsky, told NBC Philadelphia that the process of being judged in the uniform was humiliating. The women were directed to a room where the new uniforms were strewn about the floor and told to try one on and then be photographed.

Is it age discrimination or appearance discrimination? Age is a protected class, but I don't think appearance is.

A shame. Hope they can squeeze some kinda compensation out of it.

15. Getting heavier is a natural part of getting older.
You'll have a hard time convincing any jury that people in middle age should look the same as they did when they were in their early twenties.

11. I would have looked fabulous in that in my 20s and 30s
and maybe skated just by in my mid 40s but in my mid fifties it would look ridiculous. I would go with age discrimination for that reason alone

Aren't you aware of size inflation? Size 8 in 1980 is now a size 2.

about those uniforms (I know, like atlantic City cares).

Curvy and size 2 are hard to come by.

57. They could be size 4, depending on where they shop....
I'm just a bit plumper than those ladies at the moment, but I wear S, mostly size 6, and as high as 8, depending on the label. If it's Old Navy, size 4.

Curvy and size 2 is possible, if you're also short... but yeah, probably not on the top half.

Look how catty we women are to each other. Dudes do not look at each other and gossip about waist sizes the way women do amongst ourselves.

19. That is not a flapper dress. That's lingerie.
If they had really used flapper dresses there's no reason in the world why the other woman couldn't have worn the dresses too, looked good in them, and kept their jobs.

But if they want their waitresses to walk around in skimpy lingerie, of course they're going to find excuses to discriminate and only employ their fantasy eye-candy. :(

If they are requiring their women employees to dress in these uniforms that intentionally scream "My Job is all about being sexy for you!" tell me, what do you think are the odds that sexual harassment is going to be a mandatory, constant part of their job? Both from the bosses who insisted that dressing women in lingerie at work is a good idea, and from customers who are allowed and expected to ogle them?

I'm guessing the chances are pretty high.

Anyone that gets stuck working in that place... I hope they have very thick skin, very tough attitudes, and amazingly amounts of money to make it worth putting up with the obvious B.S that must go with working in that place. :(

If the answer is none, then this isn't a case of age discrimination, it's sex discrimination.

For example, I always wanted to be a cocktail waitress, not to mention a nude dancer, but would anyone hire my fat male ass? Would anyone even give me a try-out?

Nooooooo.

Lots of women get hired for those jobs, but they wouldn't even CONSIDER hiring me.

Does that mean I'm being discriminated against?

Or is that something that only happens to women?

31. Did you actually apply for a cocktail server job or are you just
complaining about the injustice of the poor downtrodden male?

Before you reply you should know a couple of things about me:

I did 8 years in Vegas casinos.

During that 8 years I ran cocktails.

During my time as a cocktail waitress, I worked with a male cocktail server.

During my time as a cocktail waitress I experienced harassment first hand, witnessed first hand and heard tales of the 'old' Vegas cocktail waitresses.

I witnessed the takeover of casinos from the 'mob' by the corporations; the mob was kinder.

Now, what was your question?

and when casinos/clubs want to "stimulate" the mail clientele, they usually go for the buxom , leggy, YOUNG, cute chickies...It's not about waitressing to the owners.. It's getting that male customer to think that if he hangs around long enough and flirts with her long enough, she will go out with him...meanwhile he's losing money at the casino. or buying overpriced drinks at the club...

Uniforms are the easiest way for owners to "cull the herd".. Many older women will not fit in them or will be humiliated into quitting.

any law suits that emerge will be dealt with by their cadre of lawyers.

It happens to men too, but not in such an overt manner.. How many companies are taken over, and mid-management's 40-50 yr olds end up having to report to 25-30 yr olds who do not value the experience of their older co-workers. It's usually not long before those older ones get "offered" early-out options or end up being laid off..

Jobs that require looks, are cruel jobs, because looks do not last, and there is always a fresh crop nipping at one's heels.

Seriously,I appreciate men trying to avoid being sexist, but lighten up! I would certainly not have any concern if a man referred to me as being a knock out (except that maybe he needed his prescription lenses changed) or that I had a nice shape. In fact, I don't know any woman who would complain at that.

Women object to crude, lewd talk and obscene gestures. We don't object to sincere statements.

So, no, I don't think I'll rephase. And in case you didn't catch it, I'm not a man. I'm a woman, probably just a little older than the women who were rudely dissed by their former employer.

The women appeared to be fit and they had curves in the right places. I am younger than these women but I am old enough not to relate to the 20 something kids anymore. Perhaps I am odd but I prefer mature women closer to my own age.

I don't see how that hideous costume would make anyone look good.

I was in a union when I was a waitress. I worked next to women and men who had worked for 25 years in the same restaurant. Bartenders and cocktail waitresses and kitchen staff included. IT was a damn good restaurant too.

“I can’t think of anything I’ve dealt with that was more disgusting and dehumanizing than what they’ve done to these women,” said Robert McDevitt, president of Local 54 of UNITE-HERE

“The company had this ridiculous explanation about how they took pictures of them in the uniform from the neck down and sent them to a modeling agency that had a three-judge panel,” he said. “These were attractive women. They were not slobs. That’s why it’s so damaging.”

McDevitt alleged that the latest round of firings involving the 16 cocktail servers clearly targeted middle-aged women. He also said the firings occurred on the very last day of a 90-day probationary period set up by the new owners.

“None of them were given notices that this was going to happen,” McDevitt said. “The reality is, they waited until the last day of the probationary period to discharge the women.”
