The law says anyone having sexual intercourse with a person other than his or her spouse is guilty of a Class A misdemeanor. It carries a maximum penalty of nine months in jail, or a $10,000 fine, or both.
The funny thing was that the bill would have still made it illegal for MARRIED persons to have sex with anyone other than their spouse, thereby, making adultery still illegal. But that wasn’t enough for puritanical Prosser, who led the opposition to those trying to kill the bill."
