Breaking: Supreme Court Overturns Brown v. Board (not kidding)
Edited on Mon Apr-04-11 06:38 PM by jaysunb
from DK

Today Americas experiment in integrated education came to an end. Today the Supreme Court upheld Arizona’s Tax voucher system in Arizona Christian School Tuition Organization v. Winn. The statute allowed Arizona tax payers to make donations to school tuition organization while filing their taxes. Any amount, up to $1000 (for a married couple) given, would then provide a dollar for dollar reduction in the State income tax due. These STO’s would then decide how much money to give to applying students for enrollment in private school. Expressly upheld are religious based STOs that restrict scholarships to members of the sponsoring church.

(See Section B. Section A rules on procedural grounds while B upholds the program).

4. Busing to end in Wake County, N.C. Goodbye, school diversity?
Edited on Mon Apr-04-11 06:52 PM by madmax
Little by little chipping away at integration. That's what It looks like to me. When will the 'White Only' fountains return?

"Busing to end in Wake County, N.C. Goodbye, school diversity?

For a decade, Wake County, N.C., used busing to avoid having schools with high concentrations of students from poor families. Its school board voted this week to abandon its income-diversity goal in favor of a return to neighborhood schools."

5. 5-4 decision denies plaintiffs standing. Right-center Kennedy is the swing, as usual

11. Kennedy is one of the most extreme right wing jurist in a hundred years.
He is only describable as center in the context of having four of the nuttiest fuckers in American history sharing the bench with him.

He isn't a swing but rather a check on some of the more unfettered madness.

Every time you describe that bastard as anything like center you butterfly effect the political spectrum toward crazy as fuck.

13. Speaking objectively, we'll get 5-4 or 4-5 decisions from this court,
depending on Kennedy's swing. I'll agree he swings right more often than left -- but that places him at the right-center of this court: I will, of course, agree that it's "in the context of having four of the nuttiest fuckers in American history sharing the bench with him"

15. All decisions aren't 5-4. I think people have been trained to oversimplify the court
and to focus on "hot button" cases.

I see four nutcases, an arch Conservative, a couple of left leaning centrists, a moderate, and a liberal.

6. One more reason to re-elect President Obama and to regain
control of the House and Senate. There will be more SCOTUS appointments. Who will make them? It's up to all of us to make sure it is not a Republican.

7. That is pretty much how I decide how to vote.
Supreme court decisions can last a very long time. We need to appoint more judges.

8. Indeed we do. Elections matter more than some people seem
to think. I can't imagine how that fact gets missed by so many.

16. I need more.
As I understand this, the court upheld that a donation to a STO, even a church STO, can be treated as a tax credit (as opposed to simply an income deduction).

Currently, you can donate as much as you want to a church and get a deduction on your taxes. The church then sets your child's tuition.

Honestly, based on my understanding, I don't see why this is so fundamental (or how it has anything to do with Brown v Board).

I'd fully agree that it's stupid, but I'm having a hard time with "unconstitutional".

Please educate me.
