A Florida attorney has been trying to get our commander-in-chief declared mentally unfit, and he is taking his case to the Supreme Court.
Its safe to say our POTUS has an
idiosyncratic style. For example, dissing a TV show hosts supposed facelift, or using a wrestling meme to call out a media outlet he dislikes. Its hard to think of another president who acted in this way. Even so, is that kind of behavior something that could get him declared mentally incompetent?
Florida attorney James Herb has been trying for over a year now, even before the November 2016 election. He argues that President Trumps actions seem to be consistent with Histrionic Personality Disorder, Narcissistic Personality Disorder, and displays of delusional beliefs.
In his petition to the Supreme Court, Herb cited all sorts of behavior covered in the media. This includes Trumps attacks on Sen. John McCain (R-Arizona), his attacks on TV show host Rosie ODonnell, his claim that Barack Obama founded ISIS, and a complaint on how he was treated by Mexican-American Judge Gonzalo Curiel. Basically, its a best hits edition of the presidents controversial statements.

(4,066 posts)I'm not sure what is considered "standing" in this sort of case. That's most likely the first thing that will get him denied review. Proving that he or others have been harmed is going to be a stretch. Yes, I know 45 has, arguably, harmed the entire nation. But I don't know that he has done it in a way that is not within his job. Other Presidents have very much harmed the entire nation by their words and deeds. His may be more often and more extreme but I don't see SCOTUS as trying to weigh in on that subject. It would be something they will try to avoid at all costs I would think.
The other thing is there is already a Constitutional remedy to this sort of issue and it doesn't include the SCOTUS ruling on the President's fitness for office. The 25th Amendment to the Constitution gives that power to the other branches. That gives the SCOTUS reason enough to deny any review.
