Mueller Is Said to Weigh Putting Off Trump Obstruction Decision(Bloomberg) -- Special Counsel Robert Muellers investigation into whether President Donald Trump obstructed justice is said to be close to completion, but he may set it aside while he finishes other key parts of his probe, such as possible collusion and the hacking of Democrats, according to current and former U.S. officials.
Thats because Mueller may calculate that if he tries to bring charges in the obstruction case -- the part that may hit closest to Trump personally -- witnesses may become less cooperative in other parts of the probe, or the president may move to shut it down altogether.
The revelation is a peek into Mullers calculations as he proceeds with his many-headed probe, while pressure builds from the presidents advisers and other Republicans to show progress or wrap it up.

(65 posts)He is found to have obstructed justice and the Congress does not impeach and remove him?
A sitting President can not be tried for a crime until after he is left office. Mueller would have his hands tied if the Congress does not remove him from office.

(30,481 posts)There is no requirement for impeachment to start. I'm not even sure I would want one to off of obstruction alone. That simply isn't enough. We have set the bar above that, IMO.

(65 posts)Everything no matter what Mueller proves all hinges on Congress impeaching and removing Trump from office because Mueller himself can take no criminal prosecutorial action against Trump as long as he is the sitting president.

What Mueller delivers to congress will have a serious impact no matter the actions of congress. Of course, a competent congress would help.

(12,344 posts)But it's rebuttal has not been mentioned as much. The rebuttal is that OLC does not make regulation or policy and prior special counsels have determined they could prosecute the president. If Mueller decides to prosecute, OLC can't stop him.

(65 posts)But it would be a decision that ultimately would have to be decided by SCOTUS. Mueller would still have his hands tied until a ruling finally was handed down on this issue.

(65 posts)Is handed down the president could be leaving office or been reelected to a second term. If that happens then I would assume many political decision would be part of the final decision .

(111,089 posts)If Trump thinks he is not going to be charged with obstruction of justice, he wouldn't dare try to fire anyone and revive the charges. It's a chess move by Mueller.
