A Question on Special Counsel Rules and Regs

My questions are these. In the event of Robert Mueller's dismissal, how is a special counsel (or special prosecutor0 created by the Congress.

Is the office created by (1). Either branch of the legislature, with no signature from the President? In other words, can the Senate, alone, create a special prosecutor without a House vote, (or vise-versa)? (2). Does it take both branches to concur, with no signature from the President. (3). Does it take both branches and a presidential signature? (4). Can an existing grand jury be taken over by a state Attorney General, within that jurisdiction, by converting the charges to state charges, thus preserving the evidence?

When the House and/or Senate is involved isn't it an Independent Counsel?

...I keep hearing that the Congress can legislate to protect Mueller. I just don't know the process.
