not to ridiculous comments made on TV by your senile TV lawyer. If Rudy did actually represent Trump in a criminal trial he would probably make a huge hash of it, and the possibility might come up then, but it's a very difficult defense that rarely succeeds. A lawyer has to have been so terrible that the client was deprived of his 6th Amendment right to counsel and that he probably wouldn't have been convicted but for the lawyer's incompetence. Criminal convictions have been affirmed on appeal even where the defense attorney fell asleep during the prosecutor's cross-examination of the defendant; was drunk throughout the trial; was in extremely poor health and senile; was mentally ill; or was himself a convicted felon whose sentence included community service in the form of defending accused murderers (despite his lack of experience in such cases). https://en.wikipedia.org/wiki/Ineffective_assistance_of_counsel

What you say about incompetent counsel being limited to criminal trials is true.

But even as a spokesman Trump could have done better. A US Attorney is an administrator. Sure, he can be praised for putting together a good team of actual trial lawyers as prosecutors, but the US Attorney himself doesn't try cases. He is making a complete ass of himself.

at this point i would not underestimate the wrecking crew. what are they really aiming at? what does Giuliani's raving public idiocy accomplish?

the first thing that jumps out at me about Trump+Ghoul is we only get statements intended for public & media consumption. there's no requirement they speak honestly or completely or clearly. they can (and do) lie like rugs, every day. they can contradict themselves at will with no consequence.

they aren't exactly shy about revealing their strategies, either. so let's go back to something that was said a couple months ago - might have been Ghoul himself who said it. the only trial that matters to them now is in the court of public opinion. since removal-from-office proceedings are handled by the senate, that's obviously the primary target -- all they need is enough senators on their side to prevent the 2/3 vote to remove from office. let's say 41 senators, to give them a margin and make cloture votes on anything very difficult.

so who does Ghoul really have to convince of anything? what is his purpose? juice up the base? not really, that's Trump's job, and he already has a network of propagandists dedicated to his cause. so Ghoul's job is probably just to sow confusion among the opposition, drive down confidence in anything useful happening as a result of any criminal or civil proceeding, make people question the decidability of any given charge. which is what he's trying to do, and he clearly feels free to move goalposts at will.

as the "reality-based" news channels squabble over whether "truth isn't truth" can somehow be translated into "he said, she said" they've already moved on to the next play. somehow, i'm pretty sure this isn't a big epistemological puzzlement at Fox News.

this is how we lose.

Giuliani's entire political career arose due to his reputation as a mob busting prosecutor when he was US Attorney for SDNY. Whatever vestige of prestige he had from that job has been totally shredded and made him a laughing stock now. Why would he do this to himself?
