I'm glad that they elected to follow some of the basic rules of due process since it undercuts claims that the hearing was unfair to Kavanaugh in some way.

(42,816 posts)In a criminal trial, those standing trial have a constitutional right to confront witnesses against them, even in cases involving sexual assault (although some states make an exception for children).
This isn't a criminal trial so they made the exception about his being present in the hearing room. But there was no way that he wasn't going to be allowed to hear Dr. Ford's testimony.
