Everything the DOJ oversees will be challenged by defense lawyers defending their clients. It could get interesting if someone challenges Whittaker's legitimacy.

But anything he is involved in could be challenged. Which is such a huge a risk, it's hard to believe he can function at all until the question is resolved.

All U.S. Attorneys are confirmed by the Senate and are authorized to settle cases on their own authority.
