Right now Reps have a two-member majority, 52-48, based on latest election returns.
If Florida flips, that drops to 51-49.
If 1 other Senator, maybe Murkowski or Flake, votes to impeach, it's a tie. Or maybe 1 Rep dies or like McCain did, becomes too disabled to vote.
It would then be a tie, with Pence the tie-breaker.
This is a conflict of interest but I know of no law that says he can't vote. So does he vote to betray Trump voters and the wrath of the GOP majority by convicting Trump, making himself president? Or vote to acquit, and pass up his shot to be President (barring winning a future election)?
I am not at all sure I'd bet on Trump beating the rap under those circumstances. I think Pence might vote to convict, and become President.
Now if there was a simulteneous impeachment of BOTH Trump and Pence, would he have to then recuse himself from casting a tie-breaking vote? Any Constitutional scholars out there?

(2,888 posts)So no tie is possible. There's no provision for the VP to vote at 66% minus one, so he's out of the picture in this regard.

That leaves Pelosi as the next in line.

(52,208 posts)even if they were to cooperate to remove both donnie and pence, they could obviously refuse to do that in the same hour, leaving enough time to confirm a new republican vice-president.
they would never hand over the white house to a democrat.
