I'm not sure just how many different laws he broke, but treason seems to be among them.
In any case, they'll undoubtedly make a behind the scenes deal for a prisoner exchange, but not right away. That's their standard procedure.

Butina has likely been given their ok to burn the group of Americans she used, willingly or otherwise. She will not give up any important Russian assets, which she likely does not know anyway. Dont be surprised if when it is all over she returns to Russia, and is welcomed as a hero.
