Only the penalty that Congress determined for treason includes mention of war. The definition of treason in the Constitution does not. Therefore, treason is broader in the Constitution than in U.S. Code. Now, get enough Congress critters together to define the penalty for treason under circumstances not governed by the same rules as acts of war.
