SCOOP: DOJ has warned the White House an emergency declaration is nearly certain to be blocked by the courts on at least a temporary basis, preventing immediate implementation of the president's plan to pay for the wall. However, WH believes they can ultimately win on appeal.

and we win when the next administration uses it as precedent to declare global warming and gun violence national emergencies. If I were a gun rights activist, I’d be doing anything and everything to get Trump to NOT declare a national emergency.

Once the executive branch lets the national emergency genie out of the bottle, there’s no putting it back in.
