She won't have to do it (although I'm sure his lawyers make that argument). Stone totally stepped on his dick, and I'd be surprised if the judge doesn't have him taken into custody or at least set a high bail (I think right now he's out on OR) and give him a fashionable ankle bracelet to wear.
