3. It could, but probably won't because if he can't be indicted as a sitting president

(not an established rule, but an opinion followed by the DoJ since 1973), it doesn't matter whether it's conspiracy or obstruction of justice (technically, the obstruction could be considered an extension of the conspiracy).

If they're not charged, the DOJ cannot publicly say anything about them per that policy.
