Mueller cannot indict Trump because of a 20 year ruling by the Justice Department has taken the position twice that the president cannot be subjected to indictment while in office, he can still be named as an unindicted co conspirator and face trial after he leaves office.
Mueller cannot indict Trump even if he finds an indictable offense. Mueller also has a specific reporting obligation to provide a confidential report to one person only: the attorney general... regulations instruct William Barr to receive the confidential report and then do two things: notify Congress that the investigation is completed, and explain to them certain specifically enumerated actions.

(115,686 posts)Nixon was listed as an unindicted co-conspirator in one of the Watergate prosecutions. https://www.nytimes.com/1974/06/07/archives/jury-named-nixon-a-coconspirator-but-didnt-indict-st-clair-confirms.html The same charges were used in the articles of impeachment voted on by the House Judiciary Committee. Granted, impeaching and convicting Trump isn't likely to happen, but if he were to appear as an unindicted coconspirator in some other indictment it would be politically useful. However, the DoJ's guidelines for grand juries now discourage references to unindicted coconspirators.

(25,855 posts)I was an adult living in the DC area during Watergate.
The unindicted part meant he got off scott free, was allowed to resign and fly back to California on AirForce 1, rather than having to schlep over to DCA and fly standby in coach.
At least with Nixon there were sensible Republicans who could tell him it was time to go. That's not going to happen now.

The most you are going to get is that he likely obstructed justice in relation to the lying to the
FBI crimes.
Which, I dunno, doesnt feel like a lot.

(5,240 posts)Russians here and abroad. The kids haven't been indicted. There are no more indictments coming. Very disappointing.

(115,686 posts)Don't forget - Rick Gates and Mike Flynn are still cooperating, and Roger Stone hasn't been tried yet. All of that could give rise to more indictments, including indictments relating to Wikileaks and Russia. My own theory, for what it's worth, is that Mueller wrapped up the OSC investigation and spun off everything that wasn't finished to other prosecutors' offices in order to preserve that evidence in the event of interference from Trump.; once his stooge Matt Whittaker was appointed acting AG that was a real possibility.
