I consider Judge Napolitano to be a friend so I write this with regret. An obstruction case where there is no proof of an underlying crime is questionable. If you add to it nothing actually obstructed, theres no case. Judge reconsider your position. This is a Weismann.

Incorrect. Obstruction of justice even applies to efforts to interfere with civil litigation. See U.S. v. Lundwall. Also, corrupt attempts to obstruct a proceeding even when one isnt the subject, is a crime. Muellers grand jury indicted many people.

Theres a section of the DOJ manual that nicely captures what obstruction of justice is about. Its got nothing to do with whether theres an underlying offense. Its all about whether someone is trying to wrongly influence a participant in federal proceeding, ...

There doesnt have to be an underlying offense; the proceeding can be about trying to figure out whether there was an underlying offense. This isnt hard.

George, you are not taking into account Rudy's knowledge of Matlock Seasons 1 - 57 and Perry Mason Seasons 1 - 98. In particular The Case of the Missing Heiress which proved a suspect is innocent if arrested on Groundhog Day and was wearing suspenders.

Either way, it's the "ask" that's illegal.
If I tell you to take a hike and not testify against me, go out of town that week, and instead you tell the prosecutors, you'll guilty of obstruction even though my director was not acted upon.
