In a speech before the right-wing Federalist Society, Vice President Mike Pence complained about federal courts blocking the Trump administration’s policies from taking effect. He said President Trump would take the issue to the Supreme Court.

Pence told the crowd that federal judges who issue nationwide injunctions against Trump’s policies “prevent the executive branch from acting, compromising our national security by obstructing the lawful ability of the president to stop threats to the homeland where he sees them.”

“The Supreme Court of the United States must clarify that district judges can decide no more than the cases before them,” Pence said. “A Supreme Court justice has to convince four of his colleagues to uphold a nationwide injunction — but a single district court judge can issue one, effectively preventing the duly-elected president of the United States from fulfilling his constitutional duties. This judicial obstruction is unprecedented. In the days ahead, our administration will seek opportunities to put this question before the Supreme Court.”


The Trump administration previously tried to take up this issue before the Supreme Court when appealing an injunction against its travel ban. But the high court never ruled on the underlying issue because they upheld the ban in its entirety, the Associated Press reported.

Courts will often issue injunctions while a case plays out. Nationwide injunctions apply to everyone as opposed to injunctions that only apply to people who brought the lawsuit.

According to Pence, the Trump administration apparently wants the Supreme Court to bar lower courts from issuing nationwide injunctions — even if the administration's policies violate the law.

A White House official told AP that the administration would look for cases that could press the Supreme Court to take up the issue.

damnndest to make a mess while heading out the door. What they don't seem to understand is that there are going to be elections and they are going to continue lose, and once they do. They'll have to deal with us wielding the tools they put in place. Not only will we wield them but it will be for something more than trying to control womens bodies and making rich people richer.

we would need to repeal the legislative filibuster in order to repeal the 1869 law that limits the number of supreme court justices to 9, and I would even go further by adding as many new states as we can to protect our changes to the court. Of course to do all these things we will need the Presidency,the Senate and the House.

If we fail to get a fair census in 2020 (and win back a tonne of state chambers in 2020) the Rethugs will have another decade of gerrymandering at multiple levels to further entrench a fundamentally extreme RW form at control, especially within the State governments, but also the US House.

If Trump wins re-election, and we fail to take back the Senate, he may very well likely will get to replace RBG, Breyer, and maybe even the chronically ill Sotomayor, we are staring down. An 8-1 radical RW SCOTUS for a decade plus will be disastrous for most all civil rights and protections. He also will litter the lower Federal courts with dozens of more fundie RW'ers. The poisonous legacy will take decades to undo.

At some point in the next 20 or so (maybe even less) years (especially if the above scenarios actually happen) we are going to start to see the country become unwoven. If the Federal government goes full RW in mandates to all the states, you are going to have the Blue States rebel, and a huge wave of secessionist thrust stat to take place. By 2040 (at the latest) a full 70% of the Senate will be controlled by only 30% of the population. That 30% is far less educated, older, far more rural, far more Fundie xian, reactionary, and white than the other 70% of the population.

It is the 250 year or so ticking constitutional time bomb that has no fix. The Electoral College issue can be sorted by simply increasing the size of the House dramatically (and then distributing the seats, and thus the EV's, much more fairly) OR by a Constitutional Amendment doing away with it altogether (much harder to get done). There is no fix for the Senate, other than adding new states (DC, Puerto Rico are the only two really feasible moves), which is, again, only a partial solution and will extraordinary hard to do as well. California could also be split into 2, which, combined with PR and DC, would give us 6 new Dem seats. THAT would solve it for decades to come.

We also seriously have to look at expanding the SCOTUS to 15 seats or so, and packing the court. The bad thing is, IF the Rethugs get an 8-1 RW court under Trump, even adding SIX new LW SCOTUS justices will still leave the RW with a mjoritory (albeit precarious).

If none of these fixes (expand the House, add new States, ultimately do away with the EC, etc) happen, and if Trump does take the court to 8-1 RW (or even 7-2, which is extremely likely if he wins re-election),and IF The Rethgs maintain state chamber control after the 2020 Census and further gerrymander, I predict the nation starts to unwind and will be teetering on dissolution by 2050 (when I would be 54 years old, so I would deffo (knock on wood) live to see this), perhaps sooner. I am not a person who suffers from normalcy bias, so this is not a near impossibility to me at all, not in the slightest. The systemic underpinnings are all in place.

the House and the courts are our thin line of defense, and trump is acting as if the supreme court is in his pocket. It's not, but it does reveal how these guys are thinking.

Their attitude is very striking. Haughty, hostile, arrogant, and very determined. We HAVE TO get everyone to vote in 2020,
and then have to change to unhackable voting methods.
