(62,444 posts)The GOP is going to make a legal threat on the basis of the (parodic) use of the GOP trademark elephant logo shape.
If the KY Democrats are really smart, they will file a DJ action in response to that threat, and have a federal court explain exactly why this qualifies for the parody species of fair use.
The court will have to explain just what the parodic message is, and why it is a substantial matter of interest deserving of parodic commentary.
