A man accused of assaulting a 13-year-old boy in Montana after the boy wouldn't remove his hat during the national anthem at a rodeo pleaded not guilty Wednesday to a felony charge of assault on a minor.
Curt James Brockway, wearing jeans and a short-sleeved plaid shirt, stood with his hands behind his back and looked intently at the judge during the short morning hearing at Mineral County Court in the town of Superior.
Judge John Larson reinstated Brockway's probationary supervision from a previous conviction, meaning Brockway must stay at home with a GPS monitor -- with the exceptions of visits with doctors and his attorney, and court appearances -- and regularly check in with a probation officer.
Brockway, 39, is next scheduled to appear for a court hearing on October 23.
The boy suffered a concussion and a fractured skull, court documents say.

(86,780 posts)the perp has a traumatic brain injury and expects to get off with a competency rating him out of trouble. Meanwhile, he has inflicted traumatic brain injury on a child. Medical care in Montana ain't cheap, hope he has to pay for this kid's care for a long time.
I hope he doesn't get any leniency, at all.

(86,780 posts)out in public without adult supervision if he is in such a condition that he can't control himself. In Montana it's a mixed bag story where some of us are horrified and others think the kid was wrong but the guy acted a little harshly. Scary.

Absolutely. He should never be allowed out in public again/imprisoned for life...perhaps he'll get the justice he so richly deserves in jail for manhandling a child ... I also wouldn't blame the parents one bit if they blew the guy away...
I'm sorry about advocating violence but this is beyond the pale...doing this to a child, a full grown adult male body slamming a child...

There have been no further reports in the kid's condition, I hope he pulls through and comes out of it with little permanent damage, though I can't imagine that happening.

Good grief, the things one must deal with, in the world of today. All totally avoidable, had 'road rage' punk not been allowed out on probation (from what I gathered in the associated articles). Perhaps in Montana, there will be justice?
