YOO: I think President Obama has exceeded his powers by making a recess appointment for Richard Cordray ... to head the new Consumer Financial Protection Bureau.

Of course this was the same John Yoo who, when asked:
If the President deems that he's got to torture somebody, including by crushing the testicles of the person's child, there is no law that can stop him?
... replied:
YOO: I think it depends on why the President thinks he needs to do that.

(14,400 posts)I don't know of any other "professor" that has to hold his classes in secret because he's afraid of facing people that may not agree with his pathetic application of the constitution.

(42,700 posts)The guy is a joke. To cite just one example, in his article, he makes the following statement: "Here, as I understand it, the Senate is not officially in adjournment (they have held "pro forma" meetings, where little to no business occurs, to prevent Obama from making exactly such appointments). So there is no question whether the adjournment has become a constitutional "recess."
Uh, John, here's a link to the Congressional Record for January 3: http://thomas.loc.gov/cgi-bin/query/B?r112:@FIELD(FLD003+d)+@FIELD(DDATE+20120103)
See the words "The Senate met in pro forma session to convene the second session of the 112th Congress at 12:01:32 p.m., and adjourned at 12:02:13 p.m. until 11 a.m., on Friday, January 6, 2012." That means, and I know this is hard, that the Senate is officially in adjournment for three days. So much for John's great legal theory.
What a pathetic hack.
