Sen. Lindsey Graham, R-S.C., will soon submit a Senate resolution calling on House Speaker Nancy Pelosi "to immediately" transmit the articles of impeachment against President Donald Trump.
A draft of Graham's resolution obtained by NBC News says the Constitution does not provide Pelosi, D-Calif., "with the power to effectively veto a resolution passed by a duly elected majority of the House of Representatives by refusing to transmit such a resolution to the Senate." Such a withholding of the articles "is a flagrant violation of the separation of powers expressly outlined in the bicameral impeachment process under the Constitution of the United States," it says.
On Sunday, Graham, who chairs the Judiciary Committee, proposed going further, telling Fox News, "If we don't get the articles this week, then we need to take matters in our own hands and change the rules."
That would allow the Senate to begin the trial without the articles being submitted, he told the network's "Sunday Morning Futures."

(1,660 posts)1) The Senate can pass as many resolutions as it wants demanding impeachment articles to be turned over, but I can't imagine a single one of them to be binding. If anything, the Supreme Court would probably have to get involved at some point. Y'all thought the disaster that's been the Trump Administration was a constitutional crisis? Ho-lee COW....!
2) The House has its own rules. The Senate cannot force the House to do anything. Just as the House can't force the Senate to do anything. If it could, the Senate would have acted on those 200 bills or so sitting on Moscow Mitch's desk right now. But they're too busy confirming any two-bit wino off the street the Lyin' King nominates as a federal judge. Hey, here's an idea, Lindsey: draft a resolution demanding that the Senate take up those bills the House have passed since 01/03/19. Let's see how well THAT goes over....
3) Pelosi never said she was planning to hold articles indefinitely. She only said she needed to know what the Senate rules were going to be regarding a trial so she'd have an idea who to send as Managers. If it TURNS OUT to be indefinite, than that's on the Senate. Set your rules and move on. This isn't rocket science.

They can change the Senate rules all they want, but they can't change the Constitution. The House has the sole power of impeachment. The Senate can have some fake dog and pony show, but it won't be the trial demanded by the Constitution. And they can't do that till they get the Articles from the House. Stand firm, Ms. Pelosi! Let them whine. That means rethugs, the media, and wayward Dems.
