Yes, Jeffrey Toobin. But will the Chief Justice participate in a historic farce??

Jeffrey Toobin just made a totally valid point on CNN when he asserted that Mitch McConnell doesn't give a crap about the "institution of the Senate." It's true. McConnell doesn't care how the Senate is perceived by reporters, citizens or historians.

But there's a wild card nobody is talking about. Will Chief Justice Roberts, who does care deeply about his own legacy and the credibility of the Supreme Court, cooperate in McConnell's plot to turn the trial into a coverup?

That's where I think some of these analysts are wrong.

Maybe Roberts will decline to participate and another justice will step in, but this spectacle won't go as easily as Moscow Mitch thinks.

McConnell wants to slip this entire process "under the radar" but that's not going to happen IMO.

If he's concerned about the legacy of his court - and he is - there's no reason for him to decline. Besides, I'm not sure that's even an option.
