... a police officer could murder a black man - knowing he was being filmed doing so, and yet without fear of the consequences thereof - says everything about where we are as a nation.

I truly hope that they receive much more significant consequences from their actions, but its a start.

What gives you the expectation this time will be different?
will merely pardon him and all his "brethren". They are all pumped by him pardoning the U.S. Navy Seal........
The next months are going to get super ugly......
Thx to NancRant for all she does........

(8,817 posts)appeal to the U.S. Supreme Court?????????????
StarfishSaver
(18,486 posts)But they'd first have to completely exhaust all of their state remedies and then go to federal district court arguing some kind of constitutional violation. It is highly unlikely they could mount such an argument since this is a basic criminal case. And in the meantime, they'd probably be sitting in jail while the appeal goes through the courts.
But even if they managed to appeal to the U.S. Supreme Court, the president couldn't pardon them because these are state crimes and he has no power to pardon those.

Like countless others in this land, I can't tell you how many times in the past 20 years, and especially
in the last three that I have said: "They can't do that" !?!? and yet,..... here we are.......
Regretfully, I guess we all are all just going to have to wait and see how it plays out........

(18,486 posts)directly to the US Supreme Court. But that was a different kind of case - among other things, cases involving elections are treated differently.
This would be a straight up criminal appeal without any time constraints or constitutional implications, so it would go through the normal appeals process.
But, as I said, even if the Supreme Court got involved, that would still not permit Trump to pardons the officers. He can only pardon people convicted of federal crimes. If they are convicted in state court, he can't do anything about it. Even if the Supreme Court rules on an appeal, it's still a state court conviction.

(8,817 posts)You sound as if you know more about law than I will ever know!
But, once again, I will say I guess we all are all just going to have to wait and see how it plays out........
I believe that we will all see some unfathomably horrific things by the RepubliCONs between now and the election.
I don't think that on November 4th, a single person in America is prepared for what is going to take place. If the Democrat candidate wins, it will not be accepted by the RepubliCONs.........period. And, so far, they don't seem to care what the Constitution says, or care about the "Rule of Law".........

(42,307 posts)He and the other LEOs knew they were being filmed and murdered the man anyway. They know, or at least assume, they can act with impunity.
Much like Central Park Karen, she knew she was being filmed and still said and did what she did.

(11,302 posts)and in Minnesota it is just barely possible (and yet unlikely) that this would even fall within the definition of 3rd Degree murder (the lowest level, just before manslaughter)
We'll see what charges are brought here.
(And it is a good thing that four officers were summarily fired in this case. That is progress. And wouldn't have happened 10 years ago.)

(1,615 posts)a little brow raising but justified. I think the template is the south carolina cop that got filmed shooting a fleeing man in the back. he got 20yrs. the key is the feds. The feds need to bring charges against them. If that happens I think all four of them are cooked.

(11,302 posts)need a solid wake up call. "Old school" isn't going to get it .. and administration needs to be all over training and indoctrination .. because we didn't get here by mistake. These men and women are being brought in and trained to do this type of policing.
We also have to acknowledge that the public has (unfortunately) been supportive of a lot of this crap in the past. (let's not forget Sheriff Arpiao, broken windows, crack babies .. and far, far too much shit*y TV and Hollywood -- Bad Boys, Chuck Norris, Charles Bronson, etc.) We've played our own part here.

Racism is not any more prevalent in USA than before. It is just being filmed more.
