It was murder.

I hesitate to say much about it because I do not trust what I might say?

But, my first question was: Is this the most common form of restraint? How could anyone hold their knee on someone's neck and not know that he has stopped breathing?

Local policemen are not above the law.

He should be put into "protective custody" and locked away until there is a verdict, in my humble opinion.

rage building up while restraining him doesn't count so much.

Now, actually out looking for a black guy to do in could be be argued as murder. As could some maniac serial killer.

But it's for lawyers to deal with the semantics of the charges-- the real point is whatever it takes to put this guy away.

He had bystanders telling him he was killing a man, and the killing took eight to nine minutes. It takes a long time to kill a human being by depriving them of oxygen. He had to be thinking about what he was doing.

I've heard prosecutors argue that formation of intent (premeditation) can occur in a matter of seconds.

Also, they didn't know each other, so this is not the same state of mind as a guy busting in on his wife in bed with another man. This looks so calculated and unprovoked. ??

Just curious.

Charge the fucking murderer. Just because white people rarely get convicted of murder doesn't mean you shouldn't charge them. If the jury wants to give a smirking murderer a murder 2 conviction that's a lesser included offense. The fucker should be charged with murder one.

And yes. I'm fucking angry about this bullshit. White folks always saying charge white folk with manslaughter. Fuck that!

in this case if cop who kneeled on his neck showed no effort to lessen the pressure on his neck despite the victim crying out for his life, it could be argued that at THAT TIME he formed intent to kill.

easiest way to get there. No doubt a bunch of other charges will pile on.

And never forget the prosecutor will be balancing his relationship with the other cops and the deprtment.

if that was a smirk on the face of the cop doing the strangling (I seemed to detect one), then it was all a big fun game to the cops. That seems to be premeditation and perhaps some degree of murder.

cuts off the breathing... but that's not what killed him (most likely).

What killed him was cutting off the caritod artery and killing his brain.

No one should have a knee on their neck for any reason. The potential to cause death or brain damage is very real (and likely).

The other officers present had a DUTY to stop such an assault at the time and tio threaten force and potentially use force to stop it.

enter the 7-11 and shoot the clerk, and you do nothing to either hinder or help the person doing the shooting, you can be charged with murder in most states, though most prosecutors would go for manslaugther for you and 1st degree murder for the person doing the shooting.

If it were a minute, or 30 seconds...maybe not. But, For 8 minutes??

Eight minutes is ....on purpose....Jury will convict the cop will the cop will get a long sentence in jail. The evidence is all over the country & cannot be erased or changed...The cop knew exactly what he was doing. When the jury watches and waits 8 minutes...and imagines what went on in that person's mind, conviction is definite. No excuse, None, Nada, Zero, etc.
