FBI's top lawyer, Dana Boente, ousted amid Fox News criticism for role in Flynn investigation

After a 38-year career with the Justice Department, the FBI's top lawyer Dana Boente was asked to resign on Friday. Two sources familiar with the decision to dismiss Boente said it came from high levels of the Justice Department rather than directly from FBI Director Christopher Wray.

His departure comes on the heels of recent criticism by Fox News for his role in the investigation of former Trump National Security Advisor Michael Flynn.

A spokesman for the FBI confirmed to NBC News that Boente did in fact resign on Friday.

Fox News has recently criticized Boente's role in the investigation of Flynn, whose criminal charge for lying to the FBI was recently dropped by the Justice Department based in part on the argument that his lies were not material to an underlying investigation. Boente signed one of the warrants renewing the FBI's authority to surveil Flynn. The warrants, known as FISA warrants, were renewed several times and had to be approved by a judge.

away so he needs to hurry to purge as many of his enemies as he can. The period between November 4 and January is going to be hell on earth for many professionals still in government.

He was nominated on October 8, 2015, and confirmed by the United States Senate on December 15, 2015, as the 60th U.S. Attorney for the Eastern District of Virginia[7] and was confirmed by the United States Senate via voice vote on December 15, 2015.[8] Boente was one of the 46 United States Attorneys ordered by Attorney General Jeff Sessions on March 10, 2017 to tender their resignation; Trump declined to accept his.[9]

Boente was not in the line of succession of the Attorney General of the United States pursuant to Executive Order 13762 signed by President Barack Obama before leaving office. He was appointed by President Donald Trump as Acting Attorney General on January 30, 2017, after Acting Attorney General Sally Yates was dismissed by Trump earlier that evening.[10][11] When Jeff Sessions was confirmed and sworn in as Attorney General on February 9, 2017, Boente became Acting Deputy Attorney General.

Boente was designated to perform the functions of the Attorney General with respect to campaign issues until the permanent deputy attorney general, Rod J. Rosenstein, was confirmed and sworn into office[17] which took place on April 25, 2017.

On October 27, 2017 Boente announced his intention to resign as U.S. Attorney and as acting assistant attorney general for the National Security Division; he said he would remain in the positions until a replacement is confirmed.[18][19]

On January 23, 2018, Boente was named general counsel to the FBI by Director Christopher Wray, filling the vacancy after James Baker's reassignment to another part of the bureau.
