Is SCOTUS going to hear a lawsuit against ACA in November? (Original Post) MoonRiver Sep 2020 OP
It is unclear they may delay it until the new justice is seated but that would be even worse. Statistical Sep 2020 #1
If it's 4-4 (and that's WITH Roberts), then the ACA is dead. Bleacher Creature Sep 2020 #2
Yes, and unfortunately it's probably not good news. Thekaspervote Sep 2020 #3

I would point out that even a 4-4 ruling means the lower court ruling stands and that was to render the individual mandate unconstitutional.

They announced they would delay their decision until after the election. They know if they completely gut the ACA pre election, it would be an even bigger loss for the gop.

So much for a non bias SCOTUS! We have to increase the number of judges!!

republicans want to take the remaining health care alonsgwith coverage for pre-existing condition away from Americans . . .

during a deathly Pandemic.

That is why they are pushing to seat the open seat left by my dear RBG. Cold hearted motherf**kers.

As I understand it, the appeals court has ruled that the ACA is unconstitutional and should be struck down in its entirety. If the SCOTUS DOESN’T hear the case, the appeals court’s ruling stands—bye bye ACA. If the SCOTUS DOES hear the case, and I am not sure when that is scheduled to take place, if at all, then we have a vastly more difficult challenge protecting the ACA without RBG on the Court.
