There are many people who are correctly concerned about Dolt45 and his unwillingness to leave office.
What I would like to say is that a presidential term ends at noon on January 20. The swearing in ceremony is a show for the supporters and the "news" media. At noon and one second The new president will be Joe Biden, who will have the power and authority to instruct the Secret Service to remove Donald Trump's crusty "239" pound ass to the curb. The Secret Service will obey President Biden's orders.
Given what I know of Biden's generosity, maybe he'll spot Trump cab fair to the train station, or for all we know, the police station for him to surrender with his three oldest idiot children.
After this 4 year nightmare with this monumentally horrible excuse for a human being in our White House, I can wait for the Inauguration.
That's my 2 cents and quite possibly overpriced at that. Thank you for reading.

A non-peaceful transfer of power in his case would involve refusal to publicly concede, rhetoric attempting to create doubt about the legitimacy of the election, filing a flood of lawsuits that would generate uncertainty in key close states, and potentially trying to interfere with the Electoral College. He could make the transition period extremely ugly indeed.
Those are legitimate concerns.

What will happen is, as you said, a flood of lawsuits challenging the results, and efforts to interfere with the EC. If he is successful in his challenge and/or his tampering with the process (and I dont know what his chances are, but there is some percentage likelihood), he will be declared the winner and all the his term will expire and hell be dragged out arguments become meaningless.
We have to vote. In overwhelming numbers. It has to be beyond challenge.

(21,146 posts)for the Speaker's succession applies to situations in which both the president and VP die (or incapacitated by illness or disaster). This order of succession became law after the JFK assassination because LBJ had been in the same motorcade.
I think there is a different provision in the law that deals with an undecided election. I believe it provides that the election be turned over to Congress, but I'm not sure if it applies to both houses, or just one - or which one it would be.
But, I'm not certain about this. Any legal eagles here that can check on this?

Thats why i suspect it will be resolved before that date. And, even if Pelosi became the interim president (whatever that is), she would likely have to turn it over to the winner - whoever that might be - eventually.
And Im not even sure Nancy would get it. Doesnt the new Congress have to vote on the speaker? When does her term expire? Can they vote on Speaker before January (assuming we hold the House)? Im not fully versed on all of that, but it looks to me like a shit show in every respect.
My takeaway is that its going to be the worst political crisis this country has ever faced - no matter what. Voting our way out of it in such numbers that there is no question is our best path.

Not sure why that doesnt get as much attention. JUST MHO..it makes headlines, keeps people tuning in. Now that the polls are so solidly in Bidens favor this close to the election, theyve dropped that topic and moved onto this one

I honestly think his statements have less to do with any real threat of trying to hang on to his position by force and more to do with his inability to contemplate a legitimate loss. If he loses it will not be because he didn't get more votes, it will be because the election was fraudulent in some way. He'll find scapegoats.
My fear, if you want to call it that, is an avalanche of law suits, rhetoric attempting to undermine the legitimacy of the process and the results, and lame duck actions that cause even more damage than he has already wrought. He'll go, but he won't go quietly or gracefully. His extinction burst is not going to be pretty. Psychopaths like him scorch the earth on their way out the door.

(24,647 posts)I really do believe most people fretting over the lack of a "peaceful transfer of power" are anticipating a messy transfer of power. It's not that they are expressing angst over the fear of no transfer of power at all.
So it isn't the fear that Trump won't go. It's the reasonable fear that he won't go quietly and with the dignity previous presidents have shown.

I'm not an expert on this, but is there any way electors could cast their vote before the mail-in ballots are tallied? If so, then their decision would be irreversible, right?

So, if a state (or states) certifies electors prior to mail-in ballots being counted, it would be disallowing all those ballots for the presidential election.

(3,467 posts)There will be claims that certain ballots are invalid and should be thrown out.
However, that will not be the actual goal. The goal is to delay the certification of the ballots. Specifically to delay it to the point where the outcome is not decided prior to the meeting of the electoral college (December 14th for this year).
If a state has not certified its election results by that time, a couple things can happen. Either the state does not appoint electors to the electoral college, or the state legislature can appoint electors.
There are several states that are likely to vote Democratic despite having Republican controlled legislatures. If the appointment of electors is left to the legislature, then it is possible that they could ignore the (uncertified) ballot and appoint Republican electors.
According to the Constitution, "Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors". This would allow this scenario to occur.
The 14th amendment impacts this somewhat as it has a statement that says (paraphrased) if anyone isn't allowed to vote to select electors, then the number of electors will be proportionally reduced by an amount relative to the number of people not allowed to vote. This could be argued to apply in this case, but the net effect would just be removing that State's electors. It it were a blue state, that would still be in Trump's favor.

I agree with what you say - if Biden is elected, then he is President on January 20th regardless of what Trump says or does.
I do fear that Trump is going to try everything he can to prevent Biden from being elected. Including attempting to have election results overturned, or sent to the courts and/or state legislatures.

I dont know what Trump will or can do to muddy the election results, but I put nothing past him. Now, hes stacking the Supreme Court to do his bidding should that be needed. So, you will have to forgive me if I worry just a little. Because in the past four years of Trump doing absolutely BULLSHIT things and completely destroying the rule of law, I have yet to see him stopped.
I disagree with the premise that this makes Democrats less likely to vote. It makes people like me even more determined to vote - to vote in such masses that even Putin cannot cast shade on the result.

(1,200 posts)The minute-by-minute breathless 24 hour cable news is not going to help. And they cant refrain from talking & speculating during a period of "wait" for results. State by state. They have never been the smartest, & the networks probably could not coordinate themselves to be patient in our best interests.
The early states "projected" results bring out the crazies to harass the western voters. Thats more my concern.

Avoid the media hype, it's going to get wound up to insane levels over the next few months.
Turn off the hate-propaganda channels on your TV, radio, and tune out.
Even disconnect from Internet media, it's of little value these days.
Try not to speculate too much about what the future will bring.
If you have decided on your vote, plan carefully.
Find out when and where you need to vote if you want to do it in person.
Closer to the day, find out the local weather. Dress appropriately, pack a lunch and a drink, if unsteady on your feet, take a folding chair.
If you haven't decided on your vote, keep up your diet of TV/ radio/Internet, but you will just get more confused.
(But you are a lost cause if you haven't decided yet, so no harm done.)
And be safe, look after body and soul in the meantime.
Wear a mask, keep your distance from those who don't.

(7,968 posts)use his legal challenges to contest the election and prevent it from being certified. If that happens and SCOTUS doesn't come up with a decision Nancy Pelosi becomes PROTUS on January 20th.
Given our current bizarre circumstances, SCOTUS may side with Trump and we should think about the ramifications of that. I'm not sure where that leads but it is nowhere good.
