It looks like he was not eligible to receive it because he received a 5% share in another company when one of his casinos went under. He would only have been eligible if he’d received nothing.

Something doesn’t sound right about that report unless he paid a bunch in the years before returns NYT has and is carrying more recent loses back. I’m not sure that’s even possible nowadays.
