Because if not Brad Parscale can pick up his confiscated guns on the way home from the hospital. Mental health is only a barrier to gun ownership if you have been adjudicated (in front of a judge), a 72 hour hold doesn't count. Alternatively, his wife could get a restraining order which would prevent them from being returned -- but we don't know the full situation there.

law enforcement can request a protection hearing allowing them to secure firearms and ammunition of a person who is a danger to themselves or others. The judge can issue such an order for upto a year, extension can be requested.
