regarding appointment the supreme court nominee went something like: Well,the people voted us in to office to do our job, and since there is nothing in the constitution that says we can't, then we should go ahead and do our job. The same goes for the democrats, especially since there is precedent in history for changing the number of justices; there is nothing in the constitution that says we can't.
