Does it need a massive, comprehensive overhaul? Absolutely.
Is the GOP going to challenge every possible thing they can? Absolutely.
Do we know what they plan on challenging, and are there ways to simply avoid allowing the situation in the first place? In many cases - ABSOLUTEY. Yeah, it's unthinkably appalling (and an extreme case) that someone has to fly from Maryland to Florida to cast a ballot that won't be challenged, but that's the kind of attitude we need to have right now. We can deal with fixing the system later, we just gotta work within it for the next week.

Because I dont think apparent winner actually means anything at all, does it?
The reality is: you have a bunch of candidates, and then once all the votes have been counted as per the laws in the state doing the counting and the SoS certifies the count, then you have a winner.
An actual winner.
Where does apparent winner fit into that process?

IIRC -- and leaving out all the shenanigans that brought it to this point in the first place -- didn't SCOTUS eventually go with the "apparent winner" in Bush vs. Gore because they were butting right up against the date when the vote had to be certified?
So they essentially said, "We're calling it, Bush is the apparent winner at this point, so he gets to be the actual winner." It came after weeks of counting and recounting votes in a closely monitored process.
(Pretty sure they also included something in there which said, "By the way, these are extreme circumstances and this highly unusual decision should not be considered precedent going forward." )
Anyway, point is that Kavanaugh is saying here that an "apparent winner" can be determined the morning after the election. Which is obviously INSANE. West coast polls don't even close until 11pm ET. Who decides who the "apparent winner" is in that instance?

It's all about the postmarks so let's hope each of the "late" ballots gets one.
Postmarking mail should be a requirement for the Post Office.
