Rudy Giuliani: Losing election lawsuits is part of our plan 'to get it to the Supreme Court'

Published 2 mins ago on November 17, 2020By David Edwards

Rudy Giuliani, an attorney for the President Donald Trump, said on Tuesday that the Trump campaign is “prepared” to lose election lawsuits with the hope that one or more are heard by the U.S. Supreme Court.

Since election day, more than a dozen lawsuits brought on behalf of the president have failed to produce results. Giuliani talked about the losing streak during an interview with Fox Business host Maria Bartiromo.

“Frankly, this is a case we would like to see get to the Supreme Court,” Giuliani said of one lawsuit in Pennsylvania. “So, you know, we’re prepared in some of these cases to lose and to appeal and to get it to the Supreme Court.”

“You’re not going to win every one of these,” he continued. “I don’t want to say it’s because of a Democrat judge or whatever. Some of them are just as fair as anybody. But in some cases you win, in some cases you lose.”

Filing lawsuit that have no evidence to support their claims means that the courts ultimately have no real jurisdition which is why all but one of these cases have been dismissed

Unless you count the one order on election day letting observers move slightly closer to the action.

Oh, or Justice Alito saying ... "Oh hey, you guys keep doing what you're already doing in Pennsylvania" wrt sequestering the later ballots.

Whether or not the SCOTUS will actually hear one of these cases is another question altogether.

It means that the Supreme Court doesn't have to take every case appealed to it, and it first has to make it through the threshold of certorari before it can even entertain arguments.

I don't see how the Supreme Court in good faith can give these clowns cert.

I'm not.

Only positive thing is that Giuliani has said the quiet part out loud - they know SCOTUS is a fucked up partisan mess.

We can use that in the arguments to add more justices

But it's true, corporations and the religious right ("Project Blitz" ) have mastered the art of (sometimes intentionally) losing cases in order to get them before the SCOTUS. Senator Whitehouse has talked a lot about this.

So many of Trump's cases are being withdrawn, not appealed. I don't think the SCOTUS will hear any of these cases.

It would be an infinitely better strategy for Rudy to win cases and then have democratic lawyers appeal to SCOTUS. His stupid admission of the game plan is not going to go over well with SCOTUS.

open in a rain storm was all part of the plan. I figured having to dry off my seat with towels would clean up that minor coffee spill. It didn't, but that WAS the plan.

Not Electoral College. Not the popular vote. Courts, so he can claim he won if not for the corrupt courts.
