(45,993 posts)On cases such as this, where emergency relief is sought in a potentially significant case, it is standard operating procedure for the Justice receiving the petition to refer it to the entire court, which is what happened here. Note that there was no opinion, no dissents, just a back of the hand, one line order denying the application for injunctive relief.
Which is what all of the experts predicted, notwithstanding some uniformed handwringing by concern trolls.

There's still the ridiculous Texas vs. Everybody Else case, brought by indicted TX AG Ken Paxton as a desperate bid for a presidential pardon; the court has to hear that one because they have original rather than appellate jurisdiction. But I can't for the life of me figure out why they think Texas has standing to complain about how other states exercise their constitutional power to manage their own elections. That one will crash and burn before long, too.

I think the legal standing/precedence issues in this one would be nightmarish and something Roberts would rather not touch with a 10-foot pole.
