What Frightens me About the Texas Lawsuit
I know it is ludicrous on legal matters but I have a hard time dismissing it for this reason.
5 That is the number of people standing between it and success. Five Supreme Court justices that are not reasonable people. Five SC justices that are hyper partisan. Three of which owe their job to Trump. My fear has gotten worse when I see multiple states and hundreds of politicians piling on to give the Supreme Court political cover. Even though I expect it to fail, I find myself fearful that the line of defense comes down to these five people that I do not trust. I would add that I never thought they would interfere in 2000 either and I was blindsided when they did. So I don't take anything for granted. As a related topic, are we even going to talk about whether the Trump appointees should recuse themselves? I know it is a non-starter but it seems painfully obvious to me that they should. Especially Barrett who was expressly appointed by Trump to protect him. I hate these assholes.

But neither does the makeup of this Court or the level of depravity of the GOP.
Things have deteriorated significantly in the last 20 years. I don't think it will work but I think our system of Government is broken that it is even allowed to come down to what 5 people think. |

More than anything, we will have a large portion of the electorate feeling cheated and they will be ungovernable.
And some small but not insignificant fraction of them will be potentially violent. We have to be on guard against the next Oklahoma City or Assassination attempt. After all is said and done, I may end up being grateful at the expanded powers that the FBI have these days. Ain't that something. |

I understand your point and I don't disagree, but Joe Biden being sworn in on that date means much more than nothing, and I will breathe an enormous sigh of relief when I watch it happen.

4. You have the right to be hate and fear this SCOTUS
But I had to think this through to calm myself down. There is no close call here and the Court will, for now, not make waves. I believe they will not take any of these cases as lower courts swat them down. Trump will go down, he will no longer hold Presidential powers and his cult will have a hard time holding their rage in a dangerous pandemic, a lessening economy and as waves of facts wash over them.
I do fear, as in the past, the piecemeal attack on every other reasonable institutions which the Right and their monied backers want disassembled for their gain. The monied backers own the Cons, the Cons in turn have the courts and as such they will find ways to rule in favor of them. |

6. This isn't about winning
This is practice. It is dress rehearsal. They are seeing in the future who will support what and how the reaction will be. They are plotting to be able to decide ANY election without having to actually get more votes. This is a party that has decided that they will govern as a minority party through suppression, intimidation, gerrymandering, and through control of the courts. The next two years will see them attempting to pass laws at the state and local levels to make it easier for them to dictate the results of elections. Look for ALEC and other organizations to pass laws, put things on referendums and other methods to make what they are practicing now, legal in the future.

And being dependent on Trump to continue in a job.
Once appointed, they are free to ignore him. That's one of the most significant reasons for lifetime appointments. |

They should tell him to pound sand and really have no reason to be pressured by him.
But loyalty and appreciation for being given the position isn't nothing. They should recuse but I assume they will not. Frankly, I would recuse because I would want nothing to do with it. |

For me to be assured that nothing can come of this lawsuit, I would have to:
(1) Trust Amy Coney Barrett to do the right thing; (2) Trust Neil Gorsuch to do the right thing; (3) Trust Samuel Alito to do the right thing; (4) Trust Brett Kavanaugh to do the right thing; and/or (5) Trust Clarence Thomas to do the right thing. I have trust issues with these people. So pardon me and let me worry a little bit. |

The next play would be to the House where the electors would be chosen BY DELEGATION where the GOP has the upper hand. We would need some Republican led delegations to do the right thing and again, I don't trust any of them for that.

It only goes to the House if no candidate get a majority of electoral votes cast. If they are excluded, then they don't count, and Biden will still have a majority.

A unanimous smackdown of this by the court on a case where in theory they could have handed a second term to Trump, would be a major counter to the argument that the current court composition is too partizan. Almost too perfect, could giving that cover for future SCOTUS ruling be the real objective of all the Pubs?
