Article I, Section 3, in relevant part:

The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Conviction requires 2/3 vote. The penalty of not being allowed to hold office would be an additional vote.

2/3 vote for conviction, where the automatic penalty is removal. Any additional penalties would be a majority vote.

This way, he can have both.
The dem senate can be 'blamed' even tho mitch will ensure the votes are there to convict behind the scenes, and the dems plus one or 2 safe seat pubbies that just won their seats can vote for the ban.

Yertle gets to keep whatever party power he has left, set himself as party head cause trumps gone, and keep the donations coming in on the argument that 'we did our part'.

The Turtle is a clever bastard, a master at process stuff, and utterly ruthless when it comes to his own position and power.

And the only elected official that counts heads better, is Nancy.

My prediction is that even from the minority, Mitch will see trump convicted and banned, if not indicted and made penniless for what he has taken from Yertle.

He IS for playing it to minimize the impact to the party's future - hence pushing the trial into the Biden era.

Mitch waits and he's off the hook for any further violence--that will fall on Dems--and he's not gonna have to preside over it. He can still see a positive outcome while not wearing a target. I'd have been amazed had he called the Senate back.

His claim he needs unanimous consent to bring the senate back. The argument is that the 2004 legislation means he doesn't. However, if he doesn't have unanimous consent he doesn't have party cover. Mitch doesn't do anything without his butt covered.

It's just easier to have the vote when Schumer takes over in that case. They're also more likely to have 67 votes after Trump leaves. You also wonder if Mitch thinks Pence would pardon Trump...

If he's no longer president and you convict...what is the remediation? You can't remove him from office. You prevent him from being eligible to run again? I say let him. And let the Republicans have to deal with it.

I'm more in favor of letting the DOJ and states AGs indict him.

At Fat Donnie. You all do realize that Mitch is manipulating the Democratic Party don't you?

Mitch has been playing the hero by saving the day in the media and letting out that he is pissed at tRUMP. But he is still really not helping the Democratic Party save the country from the lunatic that he and his Republicans have gotten ill-gotten gains from for the last 4 years and helping run out the clock on him being majority leader.

And next will come the punk move by Mitch to let the Democratic Senate Majority run the trial for getting rid of tRUMP forever, so the Republican Party can wash their hands of him forever... While letting the Democratic Party become the lightning rod for the Right Wing's Extremists to attack relentlessly for ridding the country of tRUMP. And Mitch's Republican Party can stoke the hatred and lies about the Dems being so unfair after he was gone. You know it is coming Democratic Party!
