I fail to see how this judge can allow these deportations, as if he's the one in charge of immigration. it's a federal agency who carries those deportations out.
He has no right to tie the President's hands, and he can't enforce Trump's order that he consult w/ the Texas AG, who has no right to second-guess the president's decision.
The federal government has plenary power over the enforcement of federal immigration law and an outgoing administration cannot contract away that power for an incoming administration, Justice Department lawyers wrote in a filing Sunday.

(25,485 posts)Judges rule on issues all the time. Their rulings stand until they're overturned on appeal or superseded by legislation or until they expire. That's how the process works.
For example, judges aren't in charge of abortions, yet they rule on state laws rather frequently, correct?
Those rulings clearly stand until overturned or new legislation is passed. The employment status of those involved is irrelevant.

The continuing deportations is heartless and horrifying.

In this instance it is not applicable to those run by other agencies, said Ms Rice.
The use of private prisons to detain immigrants expanded under Donald Trump, with at least 24 facilities and more than 17,000 beds added during the former presidents administration.
It addresses the Department of Justice prisons in the first instance, it is silent on what may or may not transpire with ICE facilities, added Ms Rice when pushed on the issue.

(10,085 posts)Trump created a force for evil, and they may not readily change course. The whole Dept. of Homeland Security needs an overhaul, but the first place to start is with ICE.

The judge doesn't have some independent way to deport people. That's done soley by the DHS.
ICE has no independent authority to subvert the president's wishes, much less his EO.
I'm not even sure deportations came up in the hearing. The emphasis from the judge was on the people ICE had released.
