(CNN)The Supreme Court on Monday left in place a decision that allowed a transgender student to use the bathroom that corresponded to his gender identity, a victory for the LGBTQ community that has been fearful the high court would take up the case and reverse a lower court opinion.

The case concerns the scope of Title IX that prohibits schools from discriminating "on the basis of sex." It began when Gavin Grimm, a transgender male who was then a high-school student, challenged the local school board's decision to require him to use either a unisex restroom or a restroom that corresponds to the sex, female, he was assigned at birth.


Justice Clarence Thomas and Justice Samuel Alito said they would have taken up the case for next term...................................................

It's a bathroom...
What harm can be done by students using the same bathroom?

Bathroom bills are really stupid and burdensome for everyone involved. (The student and the school district)
They are bills that are a "problem in search of a solution"...and of course, they're plain old discriminatory....

If you are a justice on the conservative side, you can look at this bill and ask, "What harm can be done by this student using x bathroom?"....The answer is, "None"...

Then you ask, "What accommodations are needed to use x bathroom"...The answer is, "None"...

Then you look at a bathroom bills, "What accommodations are needed to prevent student from using x bathroom?"
Answer, "Burdensome".....

...to show court expansion is partisan. They are being smart and letting a few slip through so they can bring the hammer down on major cases, such as gun control and the right to choose.

Where LGBT people were more or less written into the Civil Rights act. The Court said LGBT issues are issues of sex, and so where you can't discriminate based on sex, you can't discriminate against LGBT.

It's a verrrrry far-reaching ruling, and it's going to affect a lot of things in the future.

5. This court is more moderate on social issues so far

It's going to come down for corporations always, but on social issues I think we're seeing that all 3 of Gorsuch, Kavanaugh, and Coney-Barrett are willing to listen to cases and uphold precedent.

Of course, they'll be judged completely by Roe v Wade, but even when Kavanaugh was confirmed, I though his character was terrible, but that he'd be a huge disappointment to Conservatives on the bench. And I know someone who knew Coney-Barrett at Notre Dame and said she'll be serious and fair. I think there's a real chance Kavanaugh sides with Roberts and the 3 Dems on the court on Roe v Wade.

hope that it won't be the shit show I feared. I want Justice Breyer to retire ASAP...I can't imagine he has not already done so.

I think it's entirely possible, the meltdown from the Right will be visible from other solar systems.
