Im thinking it might be smart. It would help o contain it a bit. There would be legal challenges of course along with militant protest among the antivaxxers and all that. But what it would do is inoculate Biden and Dems from criticism about growth and spread of the Delta variant.

(115,681 posts)An act of Congress probably would be necessary, and it probably wouldn't survive unless/until the vaccines are approved for normal use.

Biden mandating it would just increase resistance.

(30,810 posts)The antivaxxers would be up in arms, literally. It could start a civil war.
And I wouldn't blame them, really. I still believe in the freedom to choose what happens to your body, no matter what the consequences. Even if you could justify forced vaccinations in this one case, it would be a slippery slope.

(30,810 posts)Which doesn't seem like a lot, but as we have seen, it adds up to huge numbers nationwide.
That leaves 95% of the unvaccinated to rage against such a mandate. And they could have the support of many people who simply believe it violates our civil rights.

(34,066 posts)And it would have to pass constitutional muster by satisfying the commerce clause (harder recently) or bribery by the federal government (like the $$ tied to restricting alcohol sales to 21+)

(11,736 posts)States, Counties, and municipalities would likely have an easier time legally to mandate vaccinated status for entry into school, or other areas, which would put pressure on people to vaccinate. Issuing a Federal mandate would likely be challenged in court and defeated, then Biden could be criticized for overreach.
The best strategy is for President Biden and every other Democrat to get in front of cameras every chance they get and talk about how people need to get vaccinated and call out Republicans for not doing the same and for casting doubt on the vaccines.

(12,369 posts)so what happens to the millions of Americans that refuse to get the vaccine?
Fines? Jail?
And how would you get past the courts throwing it out on 4th Amendment issues?
It's that, you know, whole freedom of choice thingy.

(12,369 posts)so I'm curious just how you would go about enforcing it within the constraints of the Constitution.

(12,369 posts)My opinion is that it would never pass Constitutional muster and would be struck down before the ink even dried.

The other thing I think should happen is higher insurance premiums - like tobacco surcharges.

(12,440 posts)The Federal Gov't has limits and requiring a vax from 340 million people isn't appropriate.
Now States and Counties have more power re: vax passports, etc...
