Clement argued in the hearing that the claims made on Fox, by its hosts or Trump's legal team, do not rise to the legal standard of defamation and are protected by the First Amendment. He also noted that guests like Powell and Giuliani were newsworthy figures discussing the biggest story of the day.
But attorneys for Smartmatic pushed back, saying the defendants made assertions of fact, not opinion, about the voting tech company, and that they do not have "blanket immunity" to spread defamatory content.
They also took issue with Clement's argument that Dobbs' show, which was cancelled in February, is primarily considered opinion programming and that the claims made on it are "more likely to be construed as opinions" for that reason.

So the funny part about this is that Smartmatic was used in one--and only one--county in the entire United States (Los Angeles County). Giuliani and Powell go on TV and make these claims:
1) Smartmatic owns Dominion or Dominion own Smartmatic. (Not true. The two companies worked on a project together a decade or so ago, and that partnership ended in litigation between the two.)
2) that it was the Smartmatic software used on Dominion machines to flip votes (most notably in Georgia). Smartmatic software is not run on Dominion machines.
3) That Smartmatic was designed FOR Hugo Chavez to rig the election in Venezuela. Designed specifically to not work correctly. (Smartmatic did supply election support for an election in Venezuela. They caught Chavez cheating. and publicly said so.)
So it seems that in order to sell the whole story that the Dominion machines were designed with nefarious intent, they pulled a completely twisted narrative about an election in Venezuela and then linked that to a non-existent connection between Dominion and Smartmatic. The Big Lie machine pulled Smartmatic into their story because they once ran an election in Venezuela, and the liars thought they could sell their Dominion story if they tied it to Hugo Chavez via Smartmatic.
Smartmatic... had a great success with its election in Los Angeles County, only to find out that they've been accused of purposefully creating inaccurate software that was used in several other states.
